Trump’s Eligibility for Colorado Ballot Still In Question as Trial Continues – “There Will Never Be a Free Election in America Again”

Former president and 2024 hopeful Donald Trump could be denied inclusion on the ballot in Colorado thanks to a group challenging his eligibility under an “insurrection clause.”

Donald Trump’s future on the Colorado ballot is uncertain this week.

Citizens for Responsibility and Ethics in Washington, a legal group that also goes by CREW, filed a lawsuit to keep Trump off Colorado’s ballot, and hearings began Monday.

If Trump “Engaged in Insurrection,” He May Be Out

The Constitution’s 14th Amendment, section 3, says that anyone who has “engaged in insurrection or rebellion,” may not hold office.

Lawyers for CREW have pointed to January 6th’s insurrection attempt on the Capitol as justification for barring Trump from re-election. 

Social Media Used as Evidence

CREW attorney Eric Olson provided details of Trump’s social media activity prior to January 6th, 2021, arguing that the former president was encouraging his supporters to act with violence in response to what Trump believed was election fraud. 

Did Trump Egg On Insurrectionists?

Encouraging his followers to attend a rally on January 6th in Washington, Trump tweeted several times before and on the date of the insurrection attempt about “stolen votes” and the “rigged” election.

“Let’s Walk Down to the Capitol”

The morning of the attack, Trump gave a speech on the Ellipse in D.C. In the speech, Trump directed his supporters to “walk down to the Capitol.”

Olson played this clip in court and said that Trump should be held accountable for this because he “knew the power of his words.”

Not long after this speech, Trump posted to Twitter (now known as X) that Mike Pence “didn’t have the courage to do what should have been done, referring to the fact that Pence certified the results of the election.

“Antidemocratic” Lawsuit Strikes a Nerve

Trump’s attorneys, calling the lawsuit “antidemocratic,” said they have proof that Trump attempted to advise his supporters to remain peaceful on January 6th, and they will provide that proof in court. 

Some Tweets Discouraged Violence, Trump’s Team Argues

They may be referring to a few tweets that Trump posted in the afternoon, after several hours of activity – some violent – had already occurred at the Capitol.

Trump’s Call for Police Support

“Please support our Capitol Police and Law Enforcement. They are truly on the side of our Country. Stay peaceful!” he tweeted.

Almost an hour later, he followed up by posting, “I am asking for everyone at the U.S. Capitol to remain peaceful. No violence! Remember, WE are the Party of Law & Order – respect the Law and our great men and women in Blue. Thank you!”

Continuing to Push a False Narrative

Despite a few comments discouraging violence against law enforcement, Trump mostly spent the day posting his election fraud theories and voicing his displeasure with Pence and states that he believed were “hiding” votes.

“We Had an Election that Was Stolen From Us”

Trump received pressure to convince his supporters to back down. In a now-deleted video posted to Twitter during the attack, he said “I know your pain. I know you’re hurt. We had an election that was stolen from us.”

“Go Home at Peace”

Asking his supporters to “go home at peace,” Trump still stated several times in the video that the election was stolen.

“These Are the Things and Events that Happen”

On the evening of January 6th, he even seemed to wrap up the day’s posts by justifying what took place.

“These are the things and events that happen when a sacred landslide election victory is so unceremoniously & viciously stripped away from great patriots who have been badly & unfairly treated for so long. Go home with love & in peace. Remember this day forever!” Trump tweeted.

Still Turning to Social Media

On Tuesday, referencing the lawsuit and Joe Biden, who is not involved in the suit, Trump posted his thoughts on Truth Social.

“If crooked Joe and the Democrats get away with removing my name from the ballot, then there will never be a free election in America again.

We will have become a dictatorship where your president is chosen for you. You will no longer have a vote, or certainly won’t have a meaningful vote.”
