In recent legal developments, the U.S. Supreme Court has denied several challenges to Donald Trump’s eligibility to run for the White House in 2024 based on the 14th amendment.
Supreme Court Rejects 2024 Eligibility Challenge
In a legal twist, the U.S. Supreme Court has rejected a case brought by John Anthony Castro, a Republican presidential nominee hopeful, challenging Donald Trump’s eligibility for the 2024 presidential election.
Castro argued that Trump should be disqualified under the 14th Amendment due to his alleged involvement in the January 6, 2021, Capitol riot.
The 14th Amendment stipulates that officials cannot hold office if they “engaged in insurrection or rebellion” or provided “aid” to insurrectionists.
The Supreme Court Declines
The Department of Justice indicted Trump on four counts related to the riot, but not for insurrection. Castro had sought Supreme Court intervention after a lower court dismissed his case for lacking legal standing.
However, the Supreme Court declined to comment on the case, leaving it unresolved.
In his petition, Castro claimed that Trump had given “aid or comfort” to insurrectionists by sympathizing with them and suggesting he might issue presidential pardons for those convicted of insurrection-related crimes if reelected.
Experts like Ilya Shapiro, director of constitutional studies at the Manhattan Institute, anticipated the Supreme Court’s rejection.
She said, “The Court will only take one of these cases if a circuit court affirms or otherwise let stand a district court ruling throwing Trump off a ballot somewhere.”
Not the Only Challenge
Castro’s lawsuit is not the only attempt to use the 14th Amendment to challenge Trump’s eligibility. Various groups, including Free Speech For People and Citizens for Responsibility and Ethics in Washington (CREW), have filed similar suits in different states.
Attacking Our Democracy
In these additional cases, these groups argue that Trump’s candidacy threatens democracy.
CREW President Noah Bookbinder said, “If the very fabric of our democracy is to hold, we must ensure that the Constitution is enforced and the same people who attacked our democratic system not be put in charge of it.”
Defending Our Republic
Bookbinder furthered his point by saying, “We aren’t bringing this case to make a point, we’re bringing it because it is necessary to defend our republic both today and in the future.”
No Legal Basis
However, Trump dismissed these claims, asserting that the 14th Amendment has no legal basis in this context.
A Truth Social Post
Trump wrote on a Truth Social post, “Almost all legal scholars have voiced opinions that the 14th Amendment has no legal basis or standing relative to the upcoming 2024 Presidential Election.”
Just Another Trick
Trump concluded his post by writing, “It is just another ‘trick’ being used by the Radical Left Communists, Marxists, and Fascists, to again steal an Election that their candidate, the WORST, MOST INCOMPETENT, & MOST CORRUPT President in U.S. history, is incapable of winning in a Free and Fair Election.”
In response to this Supreme Court decision, people seem as divided as you might expect when it comes to anything Trump
One social media user commented, “Great news for democracy and bad news for communists and socialists AKA democrats.”
However, a second user took the opposite opinion and wrote, “The one-term, twice impeached, four times criminally indicted, convicted of sexual abuse 7 defamation former guy will stay as the former guy. The American people WILL NOT elect this conman as the next president of the US.”
